Please read these Terms carefully before using our website, buying our digital products or online services, enrolling in our course, or joining our community. By using our site or purchasing or accessing any of our digital products, online services, course content, downloads or community features, you agree to these Terms. If you do not agree to them, please do not use our site or digital products.

Important legal notice: Evelyn48 is not a law firm, legal service, legal document provider, will-writing service, or legal platform. Our products and services do not replace a will, lasting power of attorney, advance decision, funeral plan, or any other formal legal document. They are designed to help you think through, organise and record your personal wishes, choices and instructions at a more detailed level. You should seek advice from a qualified solicitor or other appropriately qualified professional before relying on, signing, submitting, or acting on any document, plan, instruction, template, or decision.

1.    Who we are

This website at www.evelyn48.com (our site) and the digital products, online services, course and community described in these Terms are operated by Evelyn48 Ltd ("Evelyn48", "we", "us", "our"), a company registered in England and Wales (company number 1318866G), registered office: Dalton House, 60 Windsor Avenue, London SW1G 2RR.

2.    The agreement

These Terms, together with our Privacy & Cookie Policy and any policy referred to in them, form the agreement between you and us. Our Privacy C Cookie Policy explains how we collect, use, share, retain and safeguard personal data when you use our site, buy our digital products or online services, enrol in our course, join our community, interact with our content or contact us. These Terms apply to:

·        visitors and registered users of our site;

·        buyers of our digital products, online services, downloads and online materials;

·        members of the Honouring My Wishes online course and downloadable materials; and

·        members of our community, member areas or forums ("the Community").

3.    Eligibility and your account

You must be at least 18 years old to purchase from us, create an account, enrol in a course or join the Community. If you are given or choose login details, you must keep them confidential and not share them. We may suspend or close an account if we reasonably believe these Terms have been breached. If you suspect unauthorised access, email [email protected]. Our site and services are intended for adults aged 18 and over and are not directed at children.

4.     Digital products, online course and digital content

When you enrol in the Honouring My Wishes course, buy downloadable material, or access any other digital product, we grant you a personal, non-transferable, non-exclusive licence to access and use that content for your own private use only.

You must not copy, share, resell, publish, distribute, or give others access to any digital product, course content, community resource or downloadable material, in whole or in part. Your access is for you alone.

5.    The Community

Membership of the Community, including any membership described as “lifetime access”, gives you access to the Community features, resources and discussions made available from time to time for as long as we continue to operate the Community. “Lifetime access” means the lifetime of the Community, not your lifetime or the lifetime of Evelyn48 Ltd, and does not guarantee that any particular platform, feature, resource, format or level of activity will remain available indefinitely. We may update, change, move, suspend, restrict, replace or close the Community, or any part of it, where we reasonably consider it necessary or appropriate, including for operational, technical, safety, legal, commercial or community-management reasons. Where we permanently close the Community or materially reduce the access you purchased, we will take reasonable steps to give notice and, where appropriate, offer alternative access, replacement resources, a partial refund where required by law or appropriate in the circumstances, or another reasonable remedy. You agree to treat other members with respect and not to harvest contact details, send spam, share private member content outside the Community, or post unlawful, abusive, defamatory, discriminatory, misleading, infringing, confidential or otherwise inappropriate content. We may moderate, edit or remove content, and may suspend or remove any member who breaches these Terms or the Acceptable Use rules in clause 9.

You retain ownership of content you post or share in the Community, but you grant us permission to host, display, store, moderate, edit, remove and otherwise use that content as reasonably necessary to operate and manage the Community. Your profile name, posts, comments, uploads, reactions, progress information and other content you share may be visible to other members, administrators, tutors, moderators or platform providers depending on the platform settings, as explained in our Privacy & Cookie Policy.

Please avoid posting personal, confidential or sensitive information in the Community or in any course or member area unless you are comfortable with the relevant visibility settings and the way that information may be processed under our Privacy & Cookie Policy.

6.    Price and payment

Prices are shown at the point of purchase. Evelyn48 Ltd is not VAT registered, so VAT is not charged on our prices. Payment is taken at checkout through our payment providers, which may include Stripe, PayPal, Shopify Payments or other providers shown at checkout. We do not store your full card details. We may correct obvious pricing errors before fulfilling an order. If we identify an obvious pricing error after you have placed an order, we will contact you and give you the option to proceed at the correct price or cancel for a refund. Any refund for a pricing error will be handled in accordance with clause 7 and returned to your original payment method unless we agree otherwise.

7.    Cancellation and refunds

14-day cooling-off period. Where the law gives you a 14-day right to cancel a purchase made online, that right applies from the day after purchase, subject to the exceptions below.

Digital products, downloads and course content. By accessing, opening, streaming or downloading any digital product, course content or downloadable material during the 14-day cooling-off period, you expressly consent to us supplying that content immediately and acknowledge that you lose your right to cancel once supply has begun. No refund is given for digital content that has been accessed or downloaded, except where required by law. If a genuine technical fault prevents you from accessing content you have paid for, contact us and we will seek to resolve it or, where appropriate, provide a refund.

Community access. Community access is a digital membership feature. By joining or accessing the Community during the 14-day cooling-off period, you expressly consent to us supplying that access immediately and acknowledge that your right to cancel may be reduced or lost once access has begun, depending on the extent of access or use and what the law allows. If you have not accessed or used the Community, any refund request made within the applicable cooling-off period will be considered in accordance with your legal rights. If you have accessed or used the Community, we may make a reasonable deduction or refuse a refund where permitted by law, taking into account the access provided and any digital content, resources or member features made available to you. If a genuine technical fault prevents you from accessing Community features you have paid for, contact us and we will seek to resolve it or, where appropriate, provide a reasonable remedy or refund.

Any refund due will be returned to your original payment method unless we agree otherwise. Nothing in these Terms affects your statutory rights.

8.    Intellectual property

All content, materials, designs, text, the Evelyn48 name and logo, and the Honouring My Wishes materials are owned by or licensed to Evelyn48. You may use them only as permitted in these Terms. You must not alter, reproduce, or commercially exploit them. If you breach these Terms, your right to use our content ends immediately and you must destroy any copies.

9.    Acceptable use

You agree not to use our site, digital products, course or Community:

·        in breach of any applicable law;

·        to share login details or give others access to paid content;

·        to copy, harvest, scrape, or redistribute content or member data;

·        to upload or transmit harmful, unlawful, defamatory, or misleading material; or

·        to impersonate any person or misrepresent your identity.

We may remove content, suspend or terminate access, and report serious breaches to the authorities.

You must not upload, post, send or otherwise provide personal data about another

person unless you have a lawful basis and any required permission to do so. You must not provide personal data about children through our website, digital products, courses, Community or member areas.

10.     Important notice - not professional advice

Evelyn48 provides digital organisational tools, templates, prompts and general information only. Evelyn48 is not a law firm, legal service, legal document provider, will-writing service, or legal platform. Our digital products, course and Community are not legal, financial, tax, accounting, medical, therapeutic, counselling, or other professional advice, and must not be relied on as such.

Estate, financial, funeral and end-of-life decisions can have significant legal and financial consequences. Our materials do not replace a will, lasting power of attorney, advance decision, funeral plan, or any other formal legal document. They are intended to support your personal choices and instructions at a more detailed and practical level, but you remain responsible for your own decisions and for seeking

advice from a qualified solicitor, financial adviser, accountant, or other professional before acting. Evelyn48 does not provide regulated legal services and does not draft, prepare, review, approve, witness, submit, register, certify or validate wills or legal

documents. Evelyn48 does not guarantee that any template, plan, document,

instruction or information will be suitable for your circumstances or legally valid in any particular situation. Any wishes, preferences, choices or instructions you record using our materials are not legally binding unless they are properly included in a valid legal document or otherwise recognised under applicable law.

11.      Our liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot be excluded under law.

Subject to that, and to the fullest extent permitted by law, we are not liable for: any loss arising from your use of or inability to use our site or digital content; any reliance placed on our content; loss of profit, revenue, data, goodwill, business opportunity, or anticipated savings; or any indirect or consequential loss. Our total liability for any claim relating to a digital product or service is limited to the amount you paid for that digital product or service, except where the law does not allow such a limit.

12.      Availability and changes

Our site and digital content are provided on an “as available” basis, and we do not guarantee uninterrupted availability. We may update, change, suspend or withdraw digital content, digital products, online services, the Community, or these Terms from time to time. If a change materially affects a digital product, Community access or online service that you have already purchased, we will take reasonable steps to notify you where appropriate and will handle any remedy, replacement access or refund in accordance with these Terms and applicable law. We may also update our Privacy & Cookie Policy to reflect changes in our practices, website setup, service providers, digital products, online services or the law.

13.      Third-party links

Where our site links to third-party websites or resources, these are provided for convenience only. We are not responsible for their content or availability.

Third-party providers, including payment, e-commerce, course-delivery, community, analytics, marketing, hosting or booking providers, may process personal data as described in our Privacy & Cookie Policy and, where applicable, under their own privacy and security terms.

14.      Governing law

These Terms are governed by the laws of England and Wales. If you are a consumer, you may bring legal proceedings in the courts of England and Wales, or in the courts of the place where you live if applicable consumer law gives you that right.
